These Terms and Conditions (“Terms”) govern your access to and use of www.thegoodkindgroup.com and any related pages, forms, candidate portals, and services (collectively, the “Site”), which are owned and operated by The Goodkind Group, LLC (“Goodkind,” “we,” “us,” or “our”). By accessing or using the Site, submitting a resume or application, or otherwise engaging with our staffing and recruitment services through the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By accessing, browsing, or using the Site in any way, you confirm that you are at least 18 years of age and that you have the legal capacity to enter into these Terms. If you are using the Site on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

2. About Our Services

Goodkind is a full-service permanent and contingency staffing and recruitment consulting firm. Through the Site, we provide information about our services, industry divisions, and job openings, and we allow candidates to submit resumes and applications and allow clients and business contacts to reach us regarding staffing needs. The Site is provided for general informational purposes and to facilitate our staffing and recruiting business; it is not intended to be a comprehensive source of employment, legal, financial, or career advice.

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. When using the Site, you agree that you will not:

Provide false, inaccurate, or misleading information in any resume, application, form, or communication;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
Use the Site to submit or transmit any unlawful, defamatory, harassing, obscene, or otherwise objectionable material;
Attempt to gain unauthorized access to any portion of the Site, other accounts, or any connected systems or networks, including candidate or timesheet portals;
Introduce any virus, malware, or other harmful code, or otherwise interfere with the proper functioning of the Site;
Use any automated means, including bots, scrapers, or spiders, to access, monitor, or copy any content on the Site without our prior written consent;
Use the Site to violate the intellectual property, privacy, or other rights of any third party; or
Use the Site for any purpose that is unlawful or prohibited by these Terms.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending access, and reporting conduct to law enforcement authorities where warranted.

4. Job Applications, Resumes, and Candidate Submissions

If you submit a resume, application, or other candidate information through the Site, you represent that the information you provide is accurate, complete, and current, and that you have the right to share it with us. By submitting your information, you authorize Goodkind to review your qualifications, contact you regarding potential opportunities, and share your information with prospective client employers in connection with your job search, consistent with our Privacy Policy.

No Guarantee of Employment or Placement. Submitting a resume or application, or engaging with a Goodkind recruiter, does not guarantee that you will be placed in any position, referred to any employer, or offered any assignment. Placement decisions are made at the discretion of Goodkind and our client employers, based on business needs, qualifications, and other factors.

5. Client Inquiries and Staffing Services

Information submitted by prospective or current clients through the Site, including staffing requests and business inquiries, is used to evaluate and respond to your organization’s workforce needs. Any staffing, placement, or consulting engagement with Goodkind is subject to a separate written services agreement between Goodkind and the client, and these Terms do not themselves constitute such an agreement. In the event of a conflict between these Terms and a signed services agreement, the terms of the signed services agreement will govern.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, page layouts, and software (collectively, the “Content”), is the property of Goodkind or its licensors and is protected by copyright, trademark, and other intellectual property laws. Goodkind grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content for your personal, non-commercial use, or for legitimate business purposes related to engaging our services.

7. Third-Party Links and Platforms

The Site may contain links to third-party websites and platforms, including social media pages, job boards, and candidate or timesheet portals such as JobDiva and Bullhorn. These links are provided for your convenience only. We do not control and are not responsible for the content, availability, or privacy practices of any third-party sites. Your use of any third-party website or platform is governed by that third party’s own terms and policies, and you access such sites at your own risk.

8. Indemnification

You agree to indemnify, defend, and hold harmless Goodkind and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any information or content you submit to us that is false, misleading, or infringes the rights of a third party.

11. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or related to the Site or these Terms, will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of such courts.
